By clicking on the "I ACCEPT" button (if available) or visiting and/or using the Mar Creation website (the "Site"), you ("User") agree that you have read, understood and accepted the Terms of Use for all use of the Mar Creation Services (the "Services"), the Privacy Policy and Shipping and Return Policy (where applicable), which are incorporated herein by reference. You and Mar Creation agree to submit to the personal and exclusive jurisdiction of the courts located in New Jersey. Either Mar Creation or you may demand that any dispute between Mar Creation and you arising out of these Terms of Use must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) located in New Jersey.
If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced. Mar Creation's failure to act with respect to a breach by any User does not waive Mar Creation's right to act with respect to subsequent or similar breaches. The failure of Mar Creation to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. The section headings and subheadings contained in these Terms of Use are included for convenience only, and shall not limit or otherwise affect the terms of these Terms of Use. These Terms of Use which includes our Privacy Policy and our Shipping and Return Policy (where applicable), constitutes the entire agreement between Mar Creation and User with respect to the subject matter hereof. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Mar Creation Services or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
